If you are being sued (personal liability)

A guide to what to do in situations where you are being sued.

What to do

We need to work closely with you in situations where you are being sued. However, in all cases, you must comply with the conditions listed below, or we will either not pay your claim or we’ll reduce how much we pay:

  1. Never admit you're at fault
It may feel natural to say ‘you’re sorry’ when something goes wrong, but don’t. If you do admit fault or accept responsibility in any way, we won’t pay your claim.

  2. Get contact details from all parties involved, including witnesses, police and other officials who attended

  3. Contact Emergency Assistance immediately on +61 2 8256 1570 if there is a claim or there are any legal proceedings made against you
If you don’t contact us immediately and we determine that this could have influenced the outcome of your case, we may either not pay your claim or we’ll reduce how much we pay.

  4. Provide copies of all relevant documentation relating to the event and expenses claimed.
